Terms of Use
1. Acceptance
By accessing or using Ukubona's software or services, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the software or services.
These terms apply to the Ukubona Windows desktop application, the Ukubona web viewer, and any associated services, APIs, or websites operated by Ukubona.
2. What Ukubona Provides
Ukubona provides a DICOM viewer and associated services designed for use by healthcare professionals. The software is a tool intended to assist clinical workflows including image viewing, measurement, annotation, and collaboration.
Ukubona may update, modify, or discontinue any feature or service at any time. We will make reasonable efforts to notify users of material changes.
3. Not a Medical Device
Ukubona is a viewing and clinical decision-support tool. It is not a certified medical device approved for primary diagnosis in any jurisdiction unless specifically stated in a separate written agreement.
All clinical decisions remain the sole responsibility of the qualified healthcare professional using the software. Do not use Ukubona as the sole basis for any clinical diagnosis or treatment decision. Always apply independent professional judgment.
4. Permitted Use
You may use Ukubona for lawful purposes in healthcare, research, or education. You agree not to:
- Reverse-engineer, decompile, or disassemble the software.
- Redistribute or sublicense the software without written permission from Ukubona.
- Use the software in any way that violates applicable law.
- Use the software in a manner that violates patient privacy regulations in your jurisdiction.
- Attempt to gain unauthorised access to any Ukubona system or service.
5. Accounts
If you create an account with Ukubona, you are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@ukubona.cloud if you suspect unauthorised use of your account.
6. Patient Data Responsibility
When using Ukubona to process, view, or share patient data, you are responsible for ensuring your use complies with all applicable data protection and healthcare laws in your jurisdiction. This includes, but is not limited to, the Nigeria Data Protection Regulation (NDPR), the General Data Protection Regulation (GDPR), the Health Insurance Portability and Accountability Act (HIPAA), and any equivalent regulations applicable to you.
Ukubona provides tools and infrastructure. Compliance obligations with respect to patient data rest with the healthcare professional or institution using the software.
7. Disclaimer of Warranties
Ukubona is provided "as is" and "as available." To the maximum extent permitted by applicable law, Ukubona and its operators make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular clinical purpose, or non-infringement.
We do not warrant that the software will be uninterrupted, error-free, or free from harmful components.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Ukubona and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the software or services. This includes, but is not limited to, any clinical outcomes, patient harm, data loss, or loss of revenue.
9. Changes to These Terms
We may update these terms from time to time. We will notify registered users of material changes. Continued use of Ukubona's software or services after notification of a change constitutes your acceptance of the updated terms.
